High Court Orders AG to Take Over OSP Cases

The High Court of Ghana in Accra has directed the Attorney-General’s Department to immediately assume control over all criminal prosecutions currently being handled by the Office of the Special Prosecutor (OSP), pending formal authorisation.

The ruling,  according to citi report, was delivered on Wednesday, April 15, and marks a significant shift in Ghana’s legal and anti-corruption framework, temporarily transferring prosecutorial authority from the OSP back to the Attorney-General.

In a further directive, the Court declared all ongoing prosecutions initiated by the OSP null and void, a decision that effectively halts several high-profile cases currently before courts across the country.

Presiding judge, John Nyante Nyadu, also awarded costs of GH₵15,000 against the OSP, highlighting the Court’s stance on the procedural issues raised.
