Frank Davies, legal counsel for former Finance Minister Ken Ofori-Atta, has clarified that his client has not responded to the corruption charges because he has not been formally notified.
According to Davies, although the Office of the Special Prosecutor (OSP) reportedly filed 78 counts of corruption and related offences against Ofori-Atta and seven others in November 2025, the former minister has yet to be officially served with the charges.
The case involves allegations tied to the Strategic Mobilisation Limited contract and other financial dealings during Ofori-Atta’s tenure from 2017 to 2024.
Speaking on Joy News’ Top Story, Davies dismissed claims that his client is preparing a legal response, describing such reports as “a cacophony of noises.”
“As I speak to you now, he has not been formally notified of any charges,” Davies stated. “He is outside the jurisdiction, and if charges have been prepared, the next logical step is to notify him. That has not been done.”
Davies stressed that in Ghana’s legal system, preferring charges and notifying an accused person are separate processes. Without formal notification, he argued, Ofori-Atta cannot be expected to respond.
Ofori-Atta left Ghana in early 2025, citing medical reasons, and was later declared a fugitive by the OSP in February after failing to appear for questioning. In January 2026, he was arrested in the United States by immigration authorities for overstaying his visa but was granted bail on April 7, pending further proceedings.
Davies maintains that his client is willing to cooperate with the law once due process is followed.
“If he is properly notified, we will take the necessary steps as required by law,” he said.
