I’m not discouraged - Adu Boahene’s Lawyer reacts to the court refusing their request

The Supreme Court has dismissed an application seeking to prohibit the presiding judge in the trial of former National Signals Bureau (NSB) Director, Kwabena Adu-Boahene, from continuing to hear the case on grounds of bias.

The five-member panel maintained that the application was without merit and failed to meet the legal requirement required to disqualify a sitting judge from a case.

The defence team, led by Samuel Atta Akyea, had petitioned the apex court to stop Justice Eugene Nyadu Nyantei from presiding over the ongoing trial, alleging that the judge’s conduct had compromised the fairness of proceedings.

On October 23, 2025, Adu-Boahene’s lawyers walked out of the High Court after the presiding judge refused their request for an adjournment, prompting them to file a motion at the Supreme Court.

Speaking to reporters outside the courtroom on October 29, Mr. Atta Akyea expressed disappointment with the ruling but said that the defence team remained focused.

“I’m disappointed but not discouraged. We’ll see how the case will travel,” he said.

He stressed that he is not moved by the prospect of returning before the same judge.

“The only persuasion a judge should have is the law. I’m not going to have a banter with him, I’m not going to fight him over anything. I’m just going to protect the law,” he said. “It doesn’t move me at all.”

“We will soldier on,” he stressed.
