Torkornoo appeal is like a sacked headmaster asking to become a teacher – Guan MP

Member of Parliament for Guan, Fred Agbenyo, has drawn an analogy to explain former Chief Justice Gertrude Torkornoo’s appeal to remain a Supreme Court Judge. 

The MP likened the legal challenge by Gertrude Torkornoo to a headmaster who after being dismissed for wrongdoing, attempts to return to the school as a teacher.

Justice Torkornoo has filed an application at the High Court challenging her removal from the Supreme Court, arguing that the process for her removal as Chief Justice can not be applied to her position as a Justice of the Supreme Court.

However, Fred Agbenyo, speaking to TV3 News on September 24, insisted that once grounds for removal are established, they affect both offices.

Expanding on the analogy, he said, “How can you be a headmaster of a school that stole, you are arrested, prosecuted and dismissed. Then you say, allow me to be a teacher?”

He explained that just as the qualities required to be a headmaster are the same as those required to be a teacher, that logic applies to the judiciary.

“There are things you’re not supposed to do, so once you violate one of them, common reasoning will tell you that it penetrates through,” he said.

Mr. Agbenyo stated that he believes the former Chief Justice’s legal challenge is unlikely to succeed.

“Where we are now, I sincerely believe she’s now history.”
